These Terms & Conditions ("Terms") govern your use of stillwaterproductions.com (the "Site"), operated by MG3 Media LLC, a California limited liability company doing business as Stillwater Productions ("Stillwater," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
Use of the Site
The Site provides information about our photography, videography, and social media content services, and lets you request resources, book calls, and place orders. You agree to use the Site only for lawful purposes and in a way that doesn't infringe the rights of, or restrict the use of the Site by, anyone else. You may not attempt to gain unauthorized access to any part of the Site, interfere with its operation, scrape its content, or use it to send spam or unsolicited communications.
Services and separate agreements
Descriptions and prices on the Site are for general information and may change without notice. Actual services — including listing media packages, monthly content plans, deliverables, turnaround times, payment terms, and usage rights for the media we produce — are governed by the order form, proposal, or service agreement you accept when you book with us. If anything on the Site conflicts with a signed agreement or accepted order, the agreement or order controls.
Free resources and communications
When you request a free guide or other resource, you agree that we may contact you by email about the resource and about Stillwater's services. You can unsubscribe from marketing emails at any time. Free resources are provided for general educational purposes; results from applying them will vary and are not guaranteed.
Intellectual property
The Site and everything on it — text, photographs, videos, graphics, logos, design, and code — are owned by MG3 Media LLC or used with permission, and are protected by copyright, trademark, and other laws. Portfolio work displayed on the Site is shown with the permission of our clients for the purpose of demonstrating our services. You may view and share links to the Site, but you may not copy, download, reproduce, modify, distribute, or use any content for commercial purposes without our prior written permission. "Stillwater Productions" and the phrase "Media that moves people." are trademarks of MG3 Media LLC.
Client materials and testimonials
Where the Site displays client names, logos, results, or testimonials, they reflect those clients' actual experiences and are used with permission. They are examples of past work, not a promise of specific results for any future project.
Third-party services and links
The Site uses and links to third-party services — including scheduling tools, our client booking and delivery portal, video hosting, and social media platforms. We don't control those services and aren't responsible for their content, availability, or practices. Your use of them is subject to their own terms and privacy policies.
Disclaimer of warranties
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on it is complete, accurate, or current.
Limitation of liability
To the fullest extent permitted by law, MG3 Media LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site — even if we've been advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Liability relating to services we provide is addressed in the applicable service agreement. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to indemnify and hold harmless MG3 Media LLC and its owners, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us and make a good-faith attempt to resolve the matter informally.
Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the effective date at the top of this page. Your continued use of the Site after a change means you accept the updated Terms.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision isn't a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding use of the Site.
